These Terms of Service (“Terms”) constitute a legally binding agreement between Dheerghayush, a sole proprietorship (“Dheerghayush,” “we,” “us,” or “our”) and the individual accessing the website or availing our nutrition/wellness consultation services (“Client,” “you,” or “your”).

By accessing the website at [Website URL], booking a consultation, or otherwise using our services, you acknowledge that you have read, understood and agree to be bound by these Terms, along with our Privacy Policy. If you do not agree, please do not access or use the services.

1. Eligibility

 1.1 By using the Services, you represent that:

  1.1.1 You are at least 18 years of age, or are accessing the Services on behalf of a minor as their parent/legal guardian.

  1.1.2 The information you provide, including health Information, is accurate and complete to the best of your knowledge.

  1.1.3 You have the legal capacity to enter into a binding agreement.

 1.2 Services relating to Child & Teen Nutrition may only be availed by a parent or legal guardian on behalf of a minor, and require the guardian’s consent as described in our Privacy Policy.

2. Description of Services

 2.1 Dheerghayush provides personalised nutrition, Ayurveda-informed lifestyle coaching and holistic wellness consultation services, including but not limited to:

  2.1.1 Personalised Nutrition Consultations.

  2.1.2 Women’s Health (PCOS, hormonal balance, menstrual health, menopause).

  2.1.3 Child & Teen Nutrition.

  2.1.4 Lifestyle Disorders (diabetes, thyroid, fatty liver, high cholesterol, obesity, hypertension).

  2.1.5 Gut Health.

  2.1.6 Community membership and related wellness programmes.

 2.2 Mode of Delivery: Consultations may be offered online (video call, WhatsApp or phone) and in person.

 2.3 No Outcome Guarantee: Services are provided on a best-efforts, individually tailored basis and do not guarantee any specific health outcome.

3. Not a Substitute for Medical Care
THE SERVICES ARE INTENDED TO PROVIDE NUTRITION, LIFESTYLE AND WELLNESS GUIDANCE AND DO NOT CONSTITUTE MEDICAL ADVICE, DIAGNOSIS OR TREATMENT.

 3.1 Dheerghayush’s nutritionists and coaches are not a substitute for a licensed physician. You should consult a qualified medical practitioner before beginning any nutrition, dietary or lifestyle programme, particularly if you have an existing medical condition, are pregnant or nursing, or are taking prescription medication.

 3.2 The Services are not intended for use in a medical emergency. If you are experiencing a medical emergency, please contact a hospital or emergency services immediately.

 3.3 Any recommendations provided are based on the information voluntarily disclosed by the Client. Dheerghayush is not responsible for outcomes arising from incomplete, inaccurate or outdated information provided by the Client.

4. Booking, Consultations and Client Responsibilities

 4.1 You agree to provide accurate, current and complete information, including Health Information, when booking or attending a consultation.

 4.2 You are responsible for informing your consulting nutritionist or coach of any change in your health condition, medication or circumstances that may affect the recommendations provided to you.

 4.3 Appointment rescheduling and cancellation are subject to [Insert Rescheduling/Cancellation Policy and Notice Period, e.g., 24 hours’ notice].

5. Fees and Payment

 5.1 Fees for Services are as communicated at the time of booking and are collected through an online payment gateway on the Website or offline, depending on the Service availed.

 5.2 All fees are payable in advance unless otherwise agreed in writing.

 5.3 Except as required by law or as expressly stated in a separate Refund/Cancellation Policy, fees once paid are non-refundable, including where a Client discontinues a programme midway.

 5.4 We reserve the right to revise our fees at any time. Revised fees will apply prospectively to new bookings only.

 5.5 Payment processing is handled by our third-party payment gateway provider(s). We do not store your full card, UPI or bank account credentials.

6. Community Membership

 6.1 Where you join the Dheerghayush community (online or otherwise), you agree to engage respectfully with other members and with Dheerghayush staff, and not to share another member’s personal or health information, or any content shared within the community, outside the community without that member’s consent.

 6.2 Dheerghayush reserves the right to remove any member from the community for conduct that violates these Terms or is otherwise inappropriate.

7. Acceptable Use

 7.1 You agree not to:

  7.1.1 Impersonate any person or misrepresent your health information.

  7.1.2 Use the Services for any unlawful purpose.

  7.1.3 Copy, reproduce or redistribute any content, diet plans, programme material or other intellectual property of Dheerghayush without prior written consent.

  7.1.4 Upload or transmit any malicious code, or attempt to compromise the security of the Website; or.

  7.1.5 Use the Website or Services to harass, abuse or harm any other person.

8. Testimonials and Results

 8.1 Testimonials, reviews and case studies published on the Website reflect individual experiences and are published only with the concerned Client’s consent. Results vary from person to person based on individual health conditions, adherence and other factors, and Dheerghayush does not guarantee similar results for every Client.

9. Intellectual Property

 9.1 All content on the Website, including text, graphics, logos, diet plans, programme materials and design, is the property of Dheerghayush or its licensors and is protected under applicable intellectual property laws.

 9.2 You are granted a limited, non-exclusive, non-transferable licence to access and use the Website, and any programme material provided to you, solely for your personal, non-commercial use.

10. Third-Party Links and Services

 10.1 The Website may contain or be integrated with links to third-party websites or services, including our payment gateway, appointment scheduling tools (such as Google Workspace) and social media pages. Dheerghayush does not control, and is not responsible for, the content, privacy practices, or availability of such third-party services.

11. Confidentiality

 11.1 Dheerghayush shall treat all Health Information and other personal information shared by a Client as confidential and shall not disclose it except as described in our Privacy Policy or as required by law.

12. Disclaimers and Limitation of Liability
THE SERVICES AND WEBSITE ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

 12.1 Dheerghayush does not warrant that the Services will be uninterrupted, error-free, or will achieve any specific health outcome.

 12.2 To the maximum extent permitted by law, Dheerghayush’s aggregate liability arising out of or relating to the Services shall not exceed the fees paid by the Client for the specific Service giving rise to the claim in the six (6) months preceding the claim.

 12.3 Dheerghayush shall not be liable for any indirect, incidental, consequential or special damages arising from use of the Services.

13. Indemnification

 13.1 You agree to indemnify and hold Dheerghayush, its staff and affiliated nutritionists/coaches harmless from any claims, losses or liabilities arising from your breach of these Terms, your provision of inaccurate health information, or your misuse of the Services.

14. Term and Termination

 14.1 These Terms apply from the date you first access the Website or book a Service, and continue until your engagement with the Services ends.

 14.2 Dheerghayush may suspend or terminate your access to the Services or community at any time for breach of these Terms, non-payment, or conduct harmful to Dheerghayush, its staff or other Clients.

 14.3 You may discontinue use of the Services at any time. Discontinuation does not entitle you to a refund except as set out in any applicable Refund Policy.

15. Governing Law and Dispute Resolution

 15.1 The parties shall first attempt to resolve any dispute through good-faith negotiation. If the dispute remains unresolved, it shall be subject to the exclusive jurisdiction of the courts at Bangalore, Karnataka.

16. General Provisions

 16.1 Entire Agreement: These Terms, together with our Privacy Policy and any service-specific agreement, constitute the entire agreement between you and Dheerghayush regarding your use of the Services.

 16.2 Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force.

 16.3 No Waiver: Failure to enforce any provision shall not be deemed a waiver of that or any other provision.

 16.4 Force Majeure: Dheerghayush shall not be liable for any delay or failure in performance due to causes beyond its reasonable control, including natural disasters, epidemics, internet/telecom disruptions or government action.

 16.5 Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. Dheerghayush may assign these Terms in connection with a merger, acquisition or sale of assets.

 16.6 Electronic Communications: You consent to receive communications from us electronically, including via email, WhatsApp and the Website.

 16.7 Amendments: We may revise these Terms from time to time. Continued use of the Services after such revision constitutes acceptance of the revised Terms.
